If you are talking about the RPG type game I glanced over it a little bit but have not fully read through it.

Hey there.
I appreciate your work and it looks good, however the artwork you have worked on cannot be claimed as your own (such as the Halo art work) and in fact falls under Creative Commons as it is a copy of an already existing work.

Don't get me wrong, you do good work. I just don't think you can claim it and tell others that they can't use it when it's not an original work.

No if I took an image done by someone else and posted it up and claimed it as my own, then I would be infringing on copyright laws. I can how ever make my own rendition of things I see on TV, in movies, games, or books, as long as the work put into the drawing is done by me. I do not take credit for the concept, in fact if I know the name of the person who came up with the concept I always insure that is credited on my Rendition. You will also notice that my drawings all say 2D rendering by (unless they are modifications of friends work, to which I have permission to use it, and insure they are credited as original artist), this is to identify my work as “Fan Art”, not “Concept Art”. The work put into these renditions is mine therefore I have the right to decide whether or not you or anyone else can use them.

"Fan art using settings and characters from a previously created work could be considered a derivative work, which would place control of the copyright with the owner of that original work."

Calling it "Fan Art" changes nothing, as it still is owned by the original artists who originally produced it. And by saying other people cannot use work that was not originally yours, or you were not the original artist, is considered a form of claiming ownership.

For instance, the image of the Spartan Laser you post. Not only does it look identical to the one produced by Bungie, it also is evident with the name of the image you gave it. It may be a 2D render, but it still is evident that it is not of your own design. Meaning you cannot tell others that they are not allowed to use something that is not of your own creation or design. I've even gone and compared yours to the image done by Bungie and there's no variation in the image you posted. The text, the colors and the overall look of the Spartan Laser are the same.

Look, I don't want an argument here. It's just not legal for you to tell others that they can't use something that you originally didn't think up yourself.

Also I respect you giving credit, however that still does not change the rules to allow you to claim that no one else can use something you copied.
